Does New York have an assisted living license?
Not by that name; New York licenses adult homes and enriched housing programs, and a building in one of those categories may add Assisted Living Residence (ALR) licensure, which is what allows it to call itself assisted living.
Enhanced (EALR) and Special Needs (SNALR) certifications build on the ALR.
Who licenses adult homes in Monroe County?
The New York State Department of Health, through its Western Regional Office, Rochester Area; Monroe County and the City of Rochester do not license care settings.
Local governments handle zoning, building and fire codes for the buildings themselves.
What is a residence for adults?
A residence for adults is the third, least common type of New York adult care facility, licensed under 18 NYCRR Part 490, which provides room, board, case management and supervision, mostly to adults with mental health needs.
None of the Rochester-area licenses in our directory fall in this category.
How often is an adult home inspected in New York?
At least once a year without notice, or at least every 18 months for facilities holding the department's highest rating, under Social Services Law 461-a, plus complaint investigations.
Reports appear on NYS Health Profiles for a rolling four-year window.
What is a Stipulation and Order?
A Stipulation and Order is a settlement between the Department of Health and a facility operator in which the operator agrees to a civil penalty and corrective action without a hearing.
Each one has a number, such as ACF-25-048, listed on the facility's NYS Health Profiles page.
Do assisted living residences in New York get star ratings?
No; neither New York nor CMS rates assisted living with stars, so families read inspection reports, violation counts and enforcement actions instead.
CMS's stars apply only to nursing homes.
Can a home care agency operate inside an assisted living residence?
Yes, and many do; a licensed home care services agency, often owned by the same operator, supplies the nurses and aides who give care adult home staff may not.
The state roster lists those agencies separately, which is why some residence names appear twice.
What does the DOH regional office do?
The Department of Health's Western Regional Office, Rochester Area, at 1565 Jefferson Road, (585) 423-8020, oversees surveillance of health facilities in the region, and its surveyors carry out the inspections posted on NYS Health Profiles.
Complaints still go through the statewide hotlines.
